Bega's nutty court room drama all smoothed out

IT IS all smooth spreading in the peanut butter world for Bega Chese after a Federal Court decision.

The Federal Court of Australia confirmed Bega Cheese's right to use the well-known yellow lid and yellow label associated with its peanut butter products.

Bega Cheese acquired the peanut butter products in 2017 as part of its purchase of the Mondelez Grocery Business, formerly Kraft Foods Inc.

The company, which also owns South Burnett's Peanut Company of Australia bought the food company, which gave it the right to use the well-known packaging.

The Mondelez Grocery Business sought to prevent Bega Cheese from using this packaging trade dress.

The federal court judgment rejected this and determined that Kraft Heinz's use of the trade dress was misleading or deceptive under Australia law.

Bega Cheese executive chairman Barry Irvin said they were proud to have bought the Mondelez Grocery Business in 2017.

"Bega Cheese is a proud Australian company investing in Australian jobs, Australian manufacturing and Australian farmers,” Mr Irvin said.

"We look forward to continuing to produce and supply our customers with our much-loved peanut butter products.”

Bega Cheese acquired PCA in 2018. 

Executive general manager Adam McNamara said this acquisition allowed the company to expand its peanut butter range.

"When we look at the peanut butter space, Bega Cheese has been working hard to support Australian peanut farmers and grow the industry,” Mr McNamara said.

"We have been excited to launch our first, vertically integrated peanut butter product, Bega Simply Nuts Peanut Butter.” 

Bega Simply Nuts is the first brand to be launched by Bega Cheese since its purchase of PCA, and is the first Bega peanut brand to bring the farm to plate philosophy to life.

"After purchasing the Peanut Company of Australia, Bega has been actively working to support farmers to increase the supply of peanuts here in Australia,” Mr McNamara said.

"We're committed to helping strengthen the future of what potentially has been a fragile primary industry in Queensland.”

Since Bega Cheese's acquisition of PCA, the company has helped innovate a number of peanut products, including the Mitey Aussie Nuts from the Picky Picky Peanuts range.

"We're looking forward to continuing to explore and innovate in this space and help farmers grow the industry,” Mr McNamara said.
