THIS morning I went for my morning walk as I usually do.

During the course of my walk I was swooped by a magpie for the first time this part of the year.

I wasn't attacked physically but I got to thinking along the following lines: If I had been attacked physically, or if I had been riding a bike and fell off my bike and received some physical damage which caused me to incur expenses, what recourse would I have to claim damages for my mishap and from whom?

Could I make a claim from the owner of the residence who grew that particular tree that allowed that magpie to build its nest and as a result for that magpie to swoop on me or could I make a claim from the council which allowed the resident to grow that particular type of tree that magpies favour for building their nests.

This was not a unique experience as it happens lots of times and I hope someone can come up with an answer to my thinking.
